Abstract: Create the Manchac Wildlife Management Area Sanctuary for marine life in Lake Pontchartrain.
Present law creates sanctuary areas on Lake Pontchartrain and creates prohibitions for catching certain fish and other marine life including prohibitions for certain equipment.
Proposed law retains provisions of present law and adds the Manchac Wildlife Management Area Sanctuary to be comprised of that portion of Lake Pontchartrain adjacent to and south of the Manchac Wildlife Management Area, bounded on the north by the shoreline of said wildlife management area, on the west by a line drawn south from the western boundary of said wildlife management area near Pass Manchac, on the east by a line drawn south 9 from the boundary between the Manchac and Joyce Wildlife Management Areas, and extending waterward into Lake Pontchartrain to a line one and one-quarter miles from the shoreline. The use of crab traps in the sanctuaries is authorized. The use of legal trawls, skimmer nets, and butterfly nets is authorized in open seasons in the area of the sanctuary sanctuaries located south and east of the Interstate 10 bridge.

Abstract: Provides relative to the taking of menhaden.
Present law provides for the taking of freshwater or saltwater fish.
Proposed law retains present law.
Proposed law prohibits any person from knowingly and intentionally authorizing, directing, or having control or ownership of an agent or vessel involved in the taking menhaden for commercial purposes within the area designated by the Dept. of Wildlife and Fisheries pursuant to the Louisiana Administrative Code. Proposed law provides that notwithstanding the provisions of present law relative to penalties, whoever violates the provisions of proposed law will be held strictly liable for the taking and punished as follows: (1) For a first violation, a fine of $50,000. (2) For a second violation, a fine of $75,000 and the revocation of the violator's commercial fisherman's license for a maximum of 30 days after notice and an opportunity to be heard at an administrative hearing has occurred. (3) For a third violation, a fine of $100,000 and the revocation of the violator's commercial fisherman's license for a maximum of 365 days after notice and an opportunity to be heard at an administrative hearing has occurred. (4) For a fourth or subsequent violation, a fine of $250,000 and the permanent revocation of the violator's commercial fisherman's license after notice and an opportunity to be heard at an administrative hearing has occurred.

Present law authorizes the Louisiana Wildlife and Fisheries Commission to promulgate rules and regulations for the protection and preservation of fish, including the creation of closed zones and buffer zones within which commercial menhaden fishing is prohibited.
Proposed law retains present law and prohibits the commission from modifying any commercial menhaden buffer zone prior to August 1, 2028.

Proposed law provides for a violation subject to civil penalties for failing to retain records or knowingly providing false or fraudulent purchase records.

Abstract: Adds members to the Seafood Safety Task Force.
Present law provides for the creation of the Seafood Safety Task Force whose purpose is to serve as the state panel of experts focused on ensuring the safety of seafood processed, distributed, purchased, and consumed in La. and to provide education and awareness to consumers of the health risks associated with imported seafood. Specifies that the task force must also make recommendations on the utilization of money in the Imported Seafood Safety Fund for testing imported seafood.
Present law provides for the composition of the task force, which includes appointees by relevant legislative committees and government agencies, the chancellor of La. State University, statewide associations and boards, as well as a public health nutritionist.
Proposed law adds representatives from the oyster industry, crab industry, and finfish industry to the task force.
